Biden replaced the death penalty with life imprisonment for two inmates. They are asking to keep the death sentence.

Condemned to death in the USA, for whom President Joe Biden replaced the punishment with life imprisonment without the possibility of parole, refused to sign the relevant documents. This is reported by NBC News.
The inmates' lawyers filed lawsuits demanding the cancellation of Biden's decree. The convicted insist that they are innocent and believe that the commutation of their death sentences to life imprisonment will reduce their chances of success in appeals.
According to experts, the appeals of death row inmates are always considered particularly carefully to avoid possible judicial errors.
It is unknown whether it will be possible to refuse the commutation of the death sentence
So far, it is unclear whether the convicts will be able to refuse the commutation of the death sentence and what the court's decision will be on the lawsuits. In 1927, the US Supreme Court already established that a convict's consent to postpone execution or to a full pardon is not necessary.
President Joe Biden has commuted sentences for more than 1,500 individuals, releasing them from prisons and putting them under house arrest during the Covid-19 pandemic, information agencies report. He also pardoned 39 Americans convicted of non-violent crimes.
Earlier, Biden fully pardoned his son Hunter in two court cases. He expressed hope that Americans would understand him as a father and a president. The Democrat added that Hunter was selectively and unfairly prosecuted, as courts do not make criminal determinations regarding tax crimes in the USA. Biden also linked the accusations against his son to attempts to undermine him personally.
The President of the United States also pardoned American servicemen convicted for violating the overturned ban on LGBT relationships in the military.
